Introduction

By accessing and using the India Blockchain Summit's ("IBS"/ "our"/ "us"/ "we") online platform ("Platform") in connection with the India Blockchain Summit 2024 to be held at Talkatora Indoor Stadium, New Delhi, India, on Saturday, 19th October, 2024. ("Event"), users ("users"/ "you"/ "your") agree to comply with these Terms of Use (Terms), Privacy Policy, and Disclaimer.

Using the Platform implies that users have read, understood, and accepted these Terms & Privacy Policy and agree to be bound by them.

Users expressly agree not to infringe or violate any of IBC’s rights, including intellectual property rights such as copyright or trademark.

Our Platform uses cookies; by using our Platform, you consent to our use of cookies in accordance with our privacy and cookies policy.

By accepting the Terms, users represent and warrant that they are at least 18 years of age and have the right, authority, and legal capacity to enter into this agreement.

If you register with our Platform, submit any material to our Platform, or use any of our Platform services, you explicitly agree to these Terms.

1. License to Use Platform

• View pages from our Platform in a web browser.
• Download pages from our Platform for caching in a web browser.
• Print pages from our Platform.
• Use our Platform services by means of a web browser, subject to the other provisions of these Terms.

Except as expressly permitted by these Terms of Use, you must not download any material from our Platform or save any such material to your computer/device.

You may only use our Platform for the purpose for which it is meant, and you must not use our Platform for any other purposes.

IBC prohibits the modification, editing, and out-of-context use of the material on the Platform in any manner.

You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works based on, distribute, perform, display, or in any way exploit any of the content on the Platform, in whole or in part.

By accessing the Platform, users agree that they will not scrape or attempt to scrape or extract any data. Users also agree not to use the Platform for any monitoring, benchmarking, throttling, or any other purposes that may impair the performance or functionality of the Platform.

Users agree not to access or attempt to access any content available on the Platform by any means other than through the interface provided by IBC.

We reserve the right to restrict access to areas of our Platform, or indeed our whole Platform, at our discretion; you must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on our Platform.

2. Acceptable Use

• Use our Platform in any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
• Use our Platform in any way or take any action that causes, or may cause, damage to the Platform or impairment of the performance, availability, or accessibility of the Platform.
• Use our Platform to copy, store, host, transmit, send, use, publish, or distribute any material that consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit, or other malicious computer software.
• Use the Platform in any way or take any action that causes, or may cause, damage to the Event or prejudice to the Event.
• Access or otherwise interact with our Platform using any robot, spider, or other automated means.
• Violate the directives set out in the robots.txt file for our Platform.
• Use data collected from our Platform for any direct marketing activity (including without limitation e-mail marketing, SMS marketing, tele-marketing, and direct mailing) for any reason.
• Use data collected from our Platform to contact individuals, companies, or other persons or entities.

You must ensure that all the information you supply to us through our Platform, or in relation to the Event, is true, accurate, current, complete, and non-misleading.

3. Registration and Accounts

You may register for an account with our Platform by completing and submitting the account registration form on our Platform and clicking on the verification link in the e-mail that the Platform will send to you.

You must not allow any other person to use your account to access the Platform.

You must notify us in writing immediately if you become aware of any unauthorized use of your account.

You must not use any other person's account to access the Platform.

4. User Login Details

If you register for an account with our Platform, [we will provide you with] OR [you will be asked to choose] [a user ID and password].

Your user ID must not be liable to mislead; you must not use your account or user ID for or in connection with the impersonation of any person.

You must keep your password confidential.

5. Cancellation and Suspension of Account

If we find that you have violated these Terms of Use, we have the right to:

• Cancel your account.
• Edit your account details at any time at our sole discretion without notice or explanation.

You may cancel your account on our Platform using your account control panel on the Platform.

6. Your Content

In these Terms of Use, “your content” means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software, and files) that you submit to us or our Platform for storage or publication on, processing by, or transmission via, our Platform.

You grant to us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate, and distribute your content in any existing or future media.

You grant to us the right to sub-license these rights and the right to bring an action for infringement of these rights.

You warrant and represent that your content will comply with these Terms of Use.

Your content must not be illegal or unlawful, must not infringe any person’s legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).

Your content, and the use of your content by us in accordance with these Terms of Use, must not:

• Be defamatory or maliciously false.
• Be obscene or indecent.
• Infringe any copyright, moral right, database right, trademark right, design right, right in passing off, or other intellectual property right.
• Infringe any right of confidence, right of privacy, or right under data protection legislation.
• Constitute negligent advice or contain any negligent statement.
• Constitute an incitement to commit a crime, instructions for the commission of a crime, or the promotion of criminal activity.
• Be in contempt of any court or in breach of any court order.
• Be in breach of racial or religious hatred or discrimination legislation.
• Be blasphemous.
• Be in breach of official secrets legislation.
• Be in breach of any contractual obligation owed to any person.
• Depict violence in an explicit, graphic, or gratuitous manner.
• Be pornographic, lewd, suggestive, or sexually explicit.
• Be untrue, false, inaccurate, or misleading.
• Consist of or contain any instructions, advice, or other information which may be acted upon and could, if acted upon, cause illness, injury, or death, or any other loss or damage.
• Constitute spam.
• Be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory, or inflammatory.
• Cause annoyance, inconvenience, or needless anxiety to any person.

Your content must be appropriate, civil, and tasteful and must not:

• Be likely to deceive any person.
• Be in breach of racial or religious hatred or discrimination legislation.
• Depict violence in an explicit, graphic, or gratuitous manner.
• Be pornographic, lewd, suggestive, or sexually explicit.
• Cause annoyance, inconvenience, or needless anxiety to any person.

8. Termination

IBC reserves the right, in its sole discretion, to terminate your access to all or part of this Platform, with or without notice.

9. Limitation of Liability

To the fullest extent permitted by applicable law, IBC shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if IBC has been advised of the possibility of such damages, resulting from:

• The use or the inability to use the Platform.
• The cost of procurement of substitute goods and services resulting from any data, information, or services purchased or obtained, or messages received or transactions entered into through or from the Platform.
• Unauthorized access to or alteration of your transmissions or data.
• Statements or conduct of any third party on the Platform.
• Any other matter relating to the Platform.

10. Indemnification

Users agree to indemnify, defend, and hold harmless IBC, its officers, directors, employees, agents, affiliates, third-party information providers, licensors, and others involved in the delivery of the Platform from and against all liabilities, claims, damages, and expenses, including reasonable attorney’s fees, arising out of or related to their use of the Platform, their connection to the Platform, or their violation of these Terms.

11. Modifications to the Terms of Use

IBC reserves the right, at any time and from time to time, to update, revise, supplement, and otherwise modify these Terms and to impose new or additional rules, policies, terms, or conditions on users.

IBC shall communicate such modifications or changes by posting an updated version of these Terms on the Platform.

Any modifications or changes will be effective immediately upon posting of the revisions on the Platform, and the continued use of the Platform will constitute acceptance of such modifications or changes.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. The courts at Mumbai shall have exclusive jurisdiction in relation to any disputes arising out of or in connection with these Terms or the use of the Platform.
